Part B: Platform Terms and Conditions of Service

1. The Contractual Relationship

These Terms and Conditions (“Terms”) govern your legal relationship with the Company when using our responsive web application, booking residential textile collections (“Services”), and purchasing inventory via our integrated resale web-store (“Store”). By accessing the platform, verifying your identity via One-Time Password (OTP), or booking a collection, you enter a legally binding contract governed by English Law.

2. Service Boundary and Eligibility Check

  • 2.1 Postal Code Validation: Services are strictly restricted to verified operational zones within the United Kingdom. Users must execute the digital boundary availability test on the platform before booking. The Company holds no liability for bookings attempted outside designated operational zones.
  • 2.2 Address Selection: Users must select their explicit collection address from the verified Address Base/Royal Mail PAF dropdown menu provided on the platform. The Company accepts no liability for missed collections resulting from manually overwritten addresses or corrupted location data.

3. Residential Collection Operational Framework

  • 3.1 The 08:00 Placement Mandate: The User agrees to place all securely tied clothing collection bags outside their designated property boundary (visible and accessible from the public kerbside) prior to 08:00 AM on the confirmed date of collection.
  • 3.2 Operational Window: Collection operations commence at 08:00 AM and terminate at 18:00 PM. The Company does not guarantee an exact collection hour within this window.
  • 3.3 Driver Routing App Integration: The Company utilizes third-party automated routing software to calculate daily logistical efficiency. While automated SMS updates regarding Estimated Time of Arrival (ETA) may be dispatched to the User’s phone as a courtesy, the 08:00 AM bag placement mandate remains absolute regardless of estimated driver arrival times.
  • 3.4 Failed Pickups & Indemnity: If a driver arrives and bags are missing, inaccessible, or placed inside private property lines where the driver cannot safely access them, the collection will be marked as “Failed”. No promotional reward framework will be triggered for failed collections.

4. Acceptance Criteria and Clean Clothing Policy

4.1 Strict Exclusionary List: The Company operates exclusively as a commercial textile resale platform. We strictly do not accept:

  • Duvets, pillows, cushions, or mattresses.
  • Sleeping bags, heavy blankets, curtains, or carpets.
  • Heavily stained, damp, mouldy, wet, or severely torn items.
  • Work uniforms, industrial rags, or hazardous materials.
  • 4.2 Cleanliness Standard: We only collect clean, dry, reusable, and wearable clothing and household textiles suitable for immediate commercial resale.
  • 4.3 Driver On-Site Discretion: Drivers possess the absolute legal authority to reject any collection or leave individual bags on-site if they suspect the contents violate clause 4.1 or 4.2. Refused collections nullify voucher eligibility.

5. Instant Irrevocable Transfer of Clothing Ownership (Title)

  • 5.1 Transfer of Title: By placing items outside your house for collection by our drivers, you agree that all legal title, ownership rights, risk, and commercial interest in the textiles pass completely and permanently to the Company the exact moment our driver logs the collection as “Completed” on their logistical software application.
  • 5.2 Irrevocability: Once ownership has transferred under clause 5.1, the items immediately enter our fast-moving commercial sorting and processing pipeline. Under no circumstances can items be recalled, returned, or un-sorted for the participant, regardless of any subsequent shopping outcomes.

6. Verification and Automated Account Creation (“The Cabinet”)

  • 6.1 Mobile Phone OTP Verification: To complete a booking, users must provide a valid UK mobile telephone number. The booking is explicitly pending until the User enters the correct One-Time Password (OTP) generated via SMS.
  • 6.2 Automated User Cabinet: Upon successful verification of the SMS OTP, the system automatically creates a personal user profile workspace (“The Cabinet”) linked entirely to that verified mobile number. The Cabinet hosts the user’s collection history and active promotional vouchers.

7. Promotional Framework & Dynamic Rolling Voucher Extension

  • 7.1 Value Definition: Upon a driver logging a collection as “Completed”, the system triggers an automated reward mechanism. After 19:00 PM on the day of collection, an automated SMS containing a direct deep-link will be dispatched to the User.
  • 7.2 Core Discount Reward: The incentive award grants the user a promotional discount (fixed at 50% off, subject to future dynamic adjustments “up to 50%” upon explicit platform-wide term revisions).
  • 7.3 Scope of Discount: The discount applies automatically to the entire shopping basket total on the connected online Store.
  • 7.4 The 1-Month Expiry Rule: The discount code is valid for exactly 1 calendar month (31 days) from the timestamp of issue at 19:00 PM.
  • 7.5 Dynamic Rolling Extension Logic: Stacking multiple distinct discount codes to reduce prices past 50% is structurally impossible. However, if a user books and completes an additional free collection prior to the expiration of their current active 1-month window, the existing active 50% basket discount is preserved, and its expiration date automatically extends to exactly 1 calendar month from the date of the latest successful collection.

8. Store Authentication, Email Capture, and On-Screen Display

  • 8.1 Email Capture Mandate: To redeem the active voucher at the online Store, the user must access the deep-link via their Cabinet and provide a valid email address upon their first login attempt.
  • 8.2 Email OTP Authentication: Security and account binding require the user to input an Email One-Time Password (OTP) sent to the provided address.
  • 8.3 Automated Price Adjustment Display: Once authenticated via Email OTP, the Store platform interfaces with the Cabinet. Every product listed across the e-commerce infrastructure will dynamically modify its display properties, showing all inventory directly at half price (50% off) for the duration of the rolling promotional month.

9. Fair Use and Anti-Commercial Bulk-Buying Ban

  • 9.1 Non-Commercial Consumer Restriction: The Store is a direct-to-consumer platform. The 50% entire-basket discount is strictly for personal consumer use.
  • 9.2 Prohibited Flipping & Scraping: Users are legally barred from using this platform to bulk-buy inventory for commercial resale, market flipping, vintage wholesale distribution, or executing automated scraping scripts against newly listed stock.
  • 9.3 Remediation Rights: The Company reserves the absolute right to cancel any unfulfilled orders, reverse discounts, suspend profiles, or block residential addresses from booking future collection runs if transactional tracking logs match commercial patterns or bot profiles.

Part C: Privacy Policy & Data Protection Notice (UK GDPR Compliant)

1. Data Controller Identity

The data controller responsible for your personal data is ReFound Group Limited. We process data strictly inside the framework of the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

2. Personal Data We Collect and How We Use It

We process data on distinct legal grounds depending on the operational stage:

  • Mobile Number & SMS OTP Data: Collected to authenticate account creation and bind the User to “The Cabinet”. Lawful basis: Performance of a Contract (Article 6(1)(b) UK GDPR).
  • Residential Address & Postcode: Collected via dropdown selection to verify routing availability and allow drivers to locate bags. Lawful basis: Performance of a Contract.
  • Email Address & Email OTP Data: Captured upon first Store sign-in to authenticate access and display the 50% price configuration. Lawful basis: Performance of a Contract.
  • Transactional and Logistical Interaction Data: Log data recording driver completions, failed pick-ups, bag volume assessments, and e-commerce purchases. Lawful basis: Legitimate Interests (Article 6(1)(f) UK GDPR) to prevent fraud and maintain inventory stability.

3. Third-Party Data Processors & API Integrations

Your data is securely processed via restricted encrypted pipelines and is never sold to external advertising networks. It is shared only with the following functional processors:

  • SMS Communications Gateway Providers (e.g., Twilio / Sinch): To deliver booking OTPs, morning-of collection reminders, and evening voucher alerts.
  • Logistics & Route Planning Software Vendor: To construct optimal driver driving routes between 08:00 and 18:00. This system processes the address and booking date.
  • Cloud Hosting Infrastructure (e.g., AWS / Google Cloud): To host the server databases linking the Cabinet database seamlessly with the Store database.

4. Data Retention Limits

  • Active Accounts: Your address, contact points, and voucher history are maintained inside your Cabinet profile as long as the account remains active.
  • Inactivity & Deletion: If no collections are booked and no store logins occur for a period of 24 consecutive months, account data is automatically structurally anonymized or purged, except where financial auditing laws require transaction history archiving.

5. Your Legal Rights under UK GDPR

You maintain the right to access your data, request rectification of address errors, restrict automated processing profiles, and request full deletion (“Right to be Forgotten”) of your Cabinet and Email association. Part D: Legal Disclaimers & Limitations of Liability

1. Second-Hand Inventory Disclaimer

The online Store deals exclusively in unique, second-hand clothing and recycled textiles. The User acknowledges that stock is highly fluid and sold on a first-come, first-served basis. The Company provides absolutely no warranty or guarantee that specific sizes, brands, or styles will be available in the Store during their active 1-month discount window.

2. Marketing and Leaflet Advertisements Transparency

In compliance with the Committee of Advertising Practice (CAP) Code and consumer transparency acts, any print material (leaflets), Facebook marketing pixels, or digital ad pathways directing traffic to this web app serve purely to initiate the boundary eligibility check. No promotional offer becomes binding until a collection is successfully completed on the ground by our staff.

3. Limitation of Liability

To the maximum extent permitted by English law, the Company shall not be held liable for:

  • Theft or unauthorized removal of bags by unknown third parties from the kerbside prior to our driver arriving within the 08:00 to 18:00 window.
  • Minor delivery ETA inaccuracies delivered via automated SMS systems.
  • Temporary website server outages or SMS delivery delays caused by telecommunication network failures.

Cookies and local browser storage are small text files placed on your smartphone or desktop browser when visiting our site. They allow our systems to recognize your device across multiple pages and interactions.

2. Essential Functional Web Cookies (Mandatory)

These tracking scripts are structurally mandatory to execute core user flows and cannot be turned off without breaking the app-like behavior of the website:
